The mediation process, at a glance:
The mediation journey is a personal one – and we’ll tailor yours precisely to your needs. But there are some consistent steps we’ll follow to bring structure and stability when you need it most.
Phase one: Mediation Information and Assessment Meeting (MIAM)
In this initial, no-obligation consultation, we’ll talk you through the process, and answer any questions or concerns you may have to determine whether mediation is the right course of action for you.
Phase two – Joint mediation sessions
In your joint sessions, your mediator will speak with both of you to facilitate constructive conversations and focus on finding a way forward. We understand that contact between parties may not always be appropriate, which is we offer a shuttle mechanism (either remotely or in-person) to ensure that there is no contact between participants where preferred.
Phase three: Next steps
If an agreement is reached: We’ll prepare a Memorandum of Understanding which details all agreed matters, enabling you to apply for a legally binding order via the court.
If an agreement is not reached: There are still plenty of dispute resolution mechanisms we can explore outside of the courtroom – such as arbitration, early neutral evaluation, or private financial dispute resolution hearings.
