Client stories

Securing £4,000 in Covid-era parking penalty refunds for an NHS nurse

Overview

About our client

“Sunshine” (whose name has been changed for anonymity) is a nursing practitioner who worked on the frontline at a London hospital throughout the Covid-19 pandemic.

Like many NHS staff during this exceptionally challenging period, Sunshine worked long, demanding shifts caring for seriously ill patients against the backdrop of staffing shortages and unprecedented pressures on healthcare services.

When a series of private parking penalties culminated in legal claims and damage to her credit score, Sunshine found herself at the centre of significant financial and personal hardship – all at a time when she was simply trying to support her family and continue her vital work.

Opportunity

Overturning parking claims that affected a frontline worker’s future

During the Covid-19 pandemic, Sunshine’s hospital introduced free staff parking to support workers facing difficult conditions and staffing shortages. Staff were required to display a permit, which had to be collected and renewed through a designated office.

However, due to the demands of her role and the long hours she worked, Sunshine was not always able to visit the issuing office during its hours of operation. In lieu of a permit, Sunshine left handwritten notes in her vehicle explaining the situation while continuing to care for her patients.

As a result, a series of parking notices were issued, eventually leading to two claims against Sunshine totalling more than £4,000. One claim resulted in a default judgment being entered against her, despite Sunshine receiving no prior notice of the proceedings.

What We Did

How our Dispute Resolution experts helped overturn the claims

Knights became involved after Sunshine had already experienced considerable financial and emotional hardship as a result of the parking claims.

Led by Simon Hocking, our Dispute Resolution specialists reviewed the circumstances surrounding the claims, the judgments levelled against Sunshine, and the wider context in which the parking charges had arisen. This culminated in the withdrawal of all claims against Sunshine, and recovery of the monies she had paid.

Impact

Justice secured and a family’s future back on track

Alongside restoring Sunshine’s financial position, the outcome means that Sunshine, and her children, can move forward with their plans for the future – and put an issue that has affected the family, their finances, and their wellbeing for many years firmly behind them.

Overall, this case underscores the importance of challenging unfair claims. It highlights the role that effective legal representation can play in supporting people to overcome situations that may, at first glance, appear insurmountable.

Reflections from Knights

Simon Hocking, Dispute Resolution expert who represented Sunshine, said:

“This lady was someone who had devoted her life to frontline service, particularly during Covid times, and had experienced the worst of those times in a hospital scenario.

“As a result of this, she’d suffered a great injustice. Not only that, but that injustice was having a huge impact on her life.

“To take a problem that seemed insurmountable and put her in a position where she could take her dreams forward again was just a fantastic feeling.”

Reflections from Sunshine:

Commenting on the case, Sunshine said:

“I do feel that we, as staff looking after unwell Covid patients, were not being valued. It seems like there was no sympathy at all and it was a surprise to be hit with these fines.

“I think the parking firms, not only in my case, need to look properly before they penalise every individual, especially when it impacts your credit score. They maybe should be a little more cautious about what they’re doing, not just giving penalties because it impacts people badly.”

Key results, in review:

  • Successfully overturned parking-related judgments against the client.
  • Helped remove barriers affecting the client’s ability to purchase a home.
  • Restored the client’s financial position following years of uncertainty.
  • Delivered justice for a frontline NHS worker impacted by Covid-era parking disputes.
